Dog's Name*
Braveheart Bulliez Rescue, Inc. (“Braveheart Bulliez Rescue”) and Foster (“Foster”) hereafter. Braveheart Bulliez Rescue and Foster (may be collectively referred to herein as the “Parties”) hereby agree to the following: Foster Responsibilities During the Term (as defined herein) the Foster agrees to the following:
1. Temporary Custody: To provide adequate care and temporary guardianship of the animal until adopted in an acceptable, approved home as determined by Braveheart Bulliez Rescue;
2. Food: To provide adequate food consisting of sufficient quantity of non-contaminated and nutritionally healthy sustenance that is appropriate to the species, breed, size, age, and health of the animal. Foster agrees that it is responsible for purchasing food and other basic supplies for foster animal(s), except for donated food or supplies that may be provided by Braveheart Bulliez Rescue (as needed);
3. Water To provide adequate clean, potable water;
4. Shelter To provide clean (free of animal feces and other contaminates) and adequate shelter for the animal that is of adequate size and provides adequate protection to maintain the animal in a state of good health, and that prevents pain, suffering, or significant risk to the animal’s health. Foster home shall be a temperature-controlled environment that will not be less than fifty (50) degrees Fahrenheit or greater than eighty-five (85) degrees Fahrenheit;
5. Smoke Detectors/Extinguishers: To ensure that there is a smoke detector and fire extinguisher where foster animal(s) are housed;
6. Tethering: To NOT tether by means of any chain, rope, leash, tie out, or wire designed to restrain the animal to a stationary object or confine the animal in an inadequate pen facility. To ensure the animal will not run at large or run loose on or within the premises in such a manner as to endanger the life or limb of any person lawfully entering such premises;
7. Leashing/Under Control: To ensure that the animal is kept under reasonable restraint, and that reasonable precautions are taken to prevent public nuisance, or from animal leaving while unattended – this includes abiding by State and Municipal leash-law ordinances;
8. Teaching/Training: To make reasonable and best efforts to provide humane teaching/guidance for the animal, including but not limited to housebreaking, leash-training, and other behavioral training, as needed. Foster will make reasonable and best efforts make the animal available for and/or transport the animal to any formalized training provided by Braveheart Bulliez Rescue;
9. Adoption Events: To make every effort to provide transportation to and from adoption events and veterinary appointments as requested by Braveheart Bulliez Rescue. In the event Foster is unable to provide transportation, Foster will notify Braveheart Bulliez Rescue as soon as possible, but in no event less than forty-eight (48) hours, before any scheduled event or veterinary appointment. In the event Foster provides notice less than forty eight (48) hours of an inability to attend an adoption event or veterinary appointment, Braveheart Bulliez Rescue will make reasonable efforts to coordinate transportation;
10. Ability to Care: To contact Braveheart Bulliez Rescue in the event Foster can no longer care for the animal according to the conditions stated above;
11. Aggressive Behavior(s): Foster agrees that if animal exhibits any vicious or aggressive behavior(s), including dog bite incidents, Foster will keep the animal separate from other animals and immediately provide verbal and written notice to Braveheart Bulliez Rescue;
12. Illness: Foster agrees to immediately inform Braveheart Bulliez Rescue if the animal presents any indications of illness or seek immediate veterinary care if Foster believes there is a serious threat to the animal’s health or wellbeing;
13. Veterinary/Medical Care: Foster agrees to follow all medical treatment by a veterinarian or as instructed by Braveheart Bulliez Rescue, including but not limited to vaccinations, spay/neutering, microchipping, heartworm & parasite prevention (provided by Braveheart Bulliez Rescue);
14. No-Slip Collar & Tag: Foster agrees that any animal over the age of twelve (12) weeks will wear a Martingale/no-slip collar and identification tags provided by Braveheart Bulliez Rescue at ALL times.
15. Weekly Updates: Foster agrees that it will provide weekly updates to Braveheart Bulliez Rescue, including without limitation providing pictures, videos, behavior reports and medical condition reports.
16. Abandoned/Stray Animals: Foster agrees that it will not bring a stray or abandoned animal into the Foster’s household without the express written permission of Braveheart Bulliez Rescue. If Foster has any existing animal within the household, Foster agrees to keep any animal exhibiting vicious disposition and/or suspected of having a communicable or infectious disease housed individually;
17. Introducing Foster Animal(s): Foster agrees slowly to other animals and separate the animal from all other animals for 1-2 weeks to allow the foster animal time to decompress and acclimate to his/her new environment;
18. Foster Contract: Foster agrees to keep a copy of this Agreement and all foster paperwork readily available;
19. Leashing: Foster agrees that it is responsible to abide by the Municipal Laws and have foster animal(s) on a leash at all times outside of the home/anytime in public;
20. Home Access: Foster shall, at all reasonable times and upon notice by Braveheart Bulliez Rescue, provide access to the Foster’s home and its records for the purpose of determining compliance with the Agreement;
Braveheart Bulliez Rescue Responsibilities 1. To cover the cost of any veterinary care or medical treatment for the animal during the term of this Agreement, provided such care and/or treatment is not directly attributable to the Foster’s failure to comply with this Agreement. Such veterinary care and/or medical treatments include: vaccinations, spay/neutering, microchipping, heart-worm and parasite preventative(s); 2. To make reasonable and best efforts to market the animal for adoption; 3. To provide a Martingale/no-slip collar and identification tag; 4. To arrange discounted kenneling/boarding rates at a facility designated by Braveheart Bulliez Rescue in the event that the Foster needs to temporarily kennel/board the animal. Foster must provide at least fourteen (14) days advance notice. 5. To provide food and other essentials, as deemed necessary and as dictated by Foster circumstances.
Adoption of Foster Dog(s): If Foster decides to adopt the animal, Foster will follow Braveheart Bulliez Rescue requirements for adoption, including without limitation submitting and adoption application and executing an Adoption Agreement;
Ownership 1. The animal will remain the sole property of Braveheart Bulliez Rescue and nothing in this agreement shall be constructed to grant and right, title, or interest to Foster.
2. Braveheart Bulliez Rescue will resume legal custody of the animal and Foster will not sell, give away, or otherwise dispose of the animal.
Term 1. General Subject to the termination provisions that follow, this Agreement shall take effect as of the Effective Date and shall remain in effect until terminated by either Party (“Term”).
2. Termination for Convenience. Foster may terminate this Agreement for convenience upon fourteen (14) days written notice to Braveheart Bulliez Rescue without penalty. Braveheart Bulliez Rescue may terminate this Agreement for convenience at anytime upon written notice to Foster.
3. Termination for Default: In the event Foster fails to comply in any material respect with any term of provision of this Agreement, Foster shall be considered in default of this Agreement and Braveheart Bulliez Rescue may terminate this Agreement immediately without limiting any other rights or remedies it may have under this Agreement.
Warranties Foster represents and warrants that Foster, or any other individual in the home where the animal resides, has never been charged or convicted of any state or local animal cruelty or neglect law and/or ordinance. Foster represents and warrants that it will comply with any and all applicable laws, legislation, rules, regulations, and governmental requirements as it relates to subject matter of this Agreement.
Non-disparagement Each Party agrees not to make any oral or written statement(s) or reveal any information to any person, about the other Party which disparages or damages the other Party’s reputation or business. The Parties acknowledge that Foster’s breach or threatened breach of this Section will cause irreparable harm to Braveheart Bulliez Rescue, and that money damages may be an adequate remedy. The Parties further acknowledge and agree that Braveheart Bulliez Rescue shall at all times be entitled to seek an injunction or similar equitable relief (without the need to port any surety or bond) against a breach or threatened breach by Foster and that no other rights/remedies of Braveheart Bulliez Rescue shall be waived.
General 1. I understand that if Foster knowingly fails to comply with the above terms or in any way puts the Braveheart Bulliez Rescue foster animal in a situation which endangers its health or welfare, Braveheart Bulliez Rescue may take appropriate action, including removing the animal from my possession and/or taking legal action against Foster.
2. This Agreement shall be interpreted and enforced in accordance with the laws of the State of Georgia. The terms of this Agreement will govern additional Braveheart Bulliez Rescue future foster animals with Foster, unless Agreement is terminated by either party according to the terms of this Agreement. The Parties agree to and hereby do submit to jurisdiction before any state or federal court or record in Fulton County, Georgia. All notices under this Agreement shall be in writing and shall be effective if delivered to the Party entitled to receive the same if sent via certified mail or electronic mail with copy via first class mail to the address of the Parties listed in this Agreement.
3. I have read the above information carefully and have filled out this Agreement honestly. Any misinformation or omission of information and/or failure to answer all questions and sign the application can result in this application being declined. Also, if an omission or untruth is discovered after a dog is placed in foster, I understand that Braveheart Bulliez Rescue reserves the right to annul the foster and immediately reclaim the animal.
4. I release Braveheart Bulliez Rescue, its Board of Directors, volunteers, foster homes and representatives, and the veterinarian treating the animal, at the request of Two Tailz Rescue, from any and all claims and actions, whether for property damage caused by the animal(s) or for personal injury to me, family members and other animals in my care (personal pets or livestock) from biting, scratching, transmittal of disease, and/or any other matter attributable to said animal(s).
